Children

Our team understands that separation can have an impact on all members of a family, particularly the children and we pride ourselves on ensuring that the best interests of the children are the paramount consideration at all times.

As of 1 July 2006 the Family Law Act 1975 has undergone some signifincant reforms which aim to ensure that children spend an appropriate amount of time with both parents.  The team at Simonidis Shoebridge Lawyers ensure that they are up to date with all developments in this area of law so as to minimise the impact that separation has on your children, and you.

Whilst we always attempt to resolve children’s issues through private negotiations and mediation, our team are all skilled advocates who are capable of effectively presenting and arguing a case in Court.

We are able to assist in all aspects of children related issues including:

  • Where the children will live following the separation of the parents,The time the children will spend time with each parent following separation,
  • Relocation matters,
  • Recovery Orders,
  • Airport Alerts (these are prepared in conjunction with the Australian Federal Police and are designed to ensure that a child cannot be removed from the jurisdiction of the Commonwealth of Australia),
  • Cases involving allegations of abuse towards a child,
  • Court applications by parties who are not the parents of a child such as grandparents, or any other individual concerned for the welfare of a child or children,
  • Hague Convention Applications.
