Divorce

The process of obtaining a divorce is relatively straightforward and can often be done by the parties themselves and without the need for lawyers.  The requirements before filing for a divorce are that the marriage has irretrievably broken down, and that the two of you have been living separately and apart for at least twelve months.
 
It is worth noting that it is possible for a couple to be ‘separated’ whilst still living under the same roof however the circumstances of such a claim must be scrutinised carefully and supported by affidavit material from friends or family members who can confirm that the parties are no longer a couple, and have been living separate lives, albeit under the same roof.  We would encourage you to contact our offices to discuss this in more detail.
 
It is also important to recognise that property proceedings must be commenced in Court within twelve months of a divorce being granted.
